Former Las Cruces School Employee Pleads Guilty To Child Sex Charges

LAS CRUCES — A man accused of having sex with a female student while he was a teacher's aide at a Las Cruces middle school has pleaded no contest to three child sex charges.
Tomas Agosto, 45, of Las Cruces entered the pleas Monday to three counts of fourth-degree felony criminal sexual penetration of a minor by a school employee.
State District Judge Stephen Bridgforth ordered a 60-day diagnostic evaluation before sentencing, Deputy District Attorney Amy Orlando said.
Agosto is being held in the Dona Ana County Detention Center, Orlando said Tuesday.
A state district court jury in May convicted Agosto on six of the same charges, but deadlocked on nine identical charges, Orlando said.
Agosto entered his pleas on three of those nine charges and, in exchange for the pleas, prosecutors agreed to drop the remaining six counts, Orlando said.
"The victim didn't want to go back through and testify again,'' Orlando said.
Jose Coronado, Agosto's attorney, said the decision to enter the pleas was hard.
"He (Agosto) and his family just had a long, long talk,'' Coronado said. "Financially, it's just been tough on them.''
Agosto worked at Picacho Middle School from November 2002 to May 2004, when his contract expired and was not renewed. He was arrested last Sept. 30.
Agosto was accused of abusing the student from April 2003 to April 2004, when the girl was 13.
School officials became suspicious when the two were absent on the same days.
