State of Tennessee v. Timothy B. Lenarduzzi
M2012-01236-CCA-R3-CD
Timothy B. Lenarduzzi ("the Defendant") pleaded guilty to two counts of aggravated sexual exploitation of a minor and three counts of sexual exploitation of a minor. In his plea agreement, he agreed to a sentencing range of "[e]ight to [t]welve years at one hundred percent on each count to run concurrent," leaving the length of the sentence to be determined by the trial court.
After a hearing, the trial court sentenced the Defendant as a Range I offender to eleven years for each aggravated sexual exploitation of a minor conviction and eleven years for each sexual exploitation of a minor conviction, all to be served concurrently. On appeal, the Defendant argues that the length of his sentence is improper. After a thorough review of the record and the applicable law, we affirm the judgments of the trial court.

Martial arts instructor indicted on child pornography charges
A Hendersonville man who owned a local martial arts studio attended by dozens of children from the community was indicted on 31 counts related to the possession of child pornography by the June term of the Sumner County Grand Jury.
Timothy Lenarduzzi, 25, was indicted on two counts of aggravated sexual exploitation of a minor, three counts of sexual exploitation of a minor, and 26 counts of sexual exploitation of a minor exceeding 100 images.
Lenarduzzi, who owned Elite Martial Arts on Bonita Parkway, was arrested on March 18 by the Tennessee Bureau of Investigation after a forensic analysis of his computer showed that he was in possession of child pornography, according to TBI spokesperson Kristin Helm.
According to the arrest affidavit, a search warrant was executed on March 17 at Lenarduzzi’s Neverbreak Drive home. Lenarduzzi was present at the time of the search warrant. The TBI seized electronic equipment from the residence, which was forensically previewed by a TBI agent. The agent said he observed numerous images and videos that depicted suspected minors in sexually explicit activity.
Additionally, six videos were observed by the agent, and included children who have been rec-ognized by the National Center for Missing and Exploited Children as victims of child sexual abuse, according to the affidavit.
Aggravated sexual exploitation of a minor and sexual exploitation of a minor are Class C felonies and sexual exploitation of a minor exceeding 100 images is a Class B felony. If convicted, Lenarduzzi faces up to 15 years in prison for each Class C felony and up to 30 years in prison for each Class B felony.
He remains in Sumner County Jail on $250,000 bond. His settlement date is scheduled for Sept. 29.
Elite Martial Arts in Hendersonville has since closed its doors.
